1. Acceptance of Terms
Welcome to The Solar Soldier LLC ("The Solar Soldier," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (thesolarsoldier.com), the purchase of our merchandise, and your engagement with our solar, roofing, and electrical consulting services.
By accessing our website, purchasing products, or requesting a quote, you agree to be bound by these Terms. If you do not agree to these Terms, including the mandatory arbitration provision and class action waiver in Section 11, you must stop using our services immediately.
2. Scope of Services & Partner Relationships
2.1. Solar and Construction Consulting
The Solar Soldier LLC operates as a consultant and project facilitator. We partner with third-party Engineering, Procurement, and Construction (EPC) companies, licensed roofers, electricians, and financial institutions ("Partners") to fulfill your projects.
Role of Partners: You acknowledge that while we manage the client relationship and project coordination, the physical installation, permitting, and electrical work may be performed by our licensed Partners (e.g., Powur PBC, Sunin Energy, or local subcontractors).
Estimates vs. Contracts: Any quotes, solar production estimates, or savings calculators provided on our website are strictly estimates based on preliminary data. Final pricing and system production are subject to a formal site survey and a separate Installation Agreement.
Precedence: In the event of a conflict between these Website Terms and a signed Installation Agreement/Contract, the signed Installation Agreement shall control regarding the specific construction project.
2.2. Financial Disclaimers
The Solar Soldier LLC is not a lender or a financial institution. We facilitate introductions to third-party financing providers. All lending decisions, interest rates, and loan terms are determined solely by the lender, not by us. We do not guarantee loan approval.
3. E-Commerce & Merchandise Terms
3.1. Product Availability and Pricing
We sell clothing and branded merchandise directly through our website. Prices and availability are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
3.2. Shipping and Risk of Loss
All items purchased from The Solar Soldier LLC are made pursuant to a shipment contract. This means the risk of loss and title for such items pass to you upon our delivery to the carrier (USPS, UPS, FedEx, etc.). We are not responsible for delays caused by shipping carriers or customs.
3.3. Returns and Refunds
Merchandise: Returns on unworn, unwashed clothing with original tags are accepted within 14 days of delivery. The customer is responsible for return shipping costs unless the item arrived defective.
Services: Fees paid for solar consultations or deposits are subject to the refund terms outlined in your specific Installation Agreement.
4. User Conduct & Prohibited Uses
You agree not to use the Website or our services:
In any way that violates federal, state, or local laws (including Lisle, IL municipal codes).
To engage in fraudulent activity, including using stolen credit card information to purchase merchandise.
To impersonate The Solar Soldier LLC or its employees.
5. SMS and Telemarketing Consent (TCPA)
By submitting your contact information on our website, you expressly consent to receive communications from us and our partners via phone calls, prerecorded messages, and text messages (SMS/MMS) regarding your inquiry, project updates, and marketing offers.
Consent: You agree that this consent applies even if your number is listed on a corporate, state, or federal Do Not Call registry.
Opt-Out: You may opt out of SMS marketing at any time by replying STOP.
6. Intellectual Property Rights
The Website, its content, the "The Solar Soldier" brand, logos, and merchandise designs are owned by The Solar Soldier LLC and are protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content or apparel designs without express written permission.
7. Third-Party Links and Services
Our website may contain links to third-party websites (e.g., financing portals, manufacturer specs). We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.
8. Disclaimer of Warranties
8.1. Website & Merchandise: The website and all merchandise are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.
8.2. Service Results: We do not guarantee specific energy savings or government incentive eligibility (e.g., Solar Investment Tax Credit), as these depend on utility rates, government policy, and your personal tax situation.1
9. Limitation of Liability2
To the ful3lest extent permitted by law, The Solar Soldier LLC, its officers, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of:

Defects in merchandise purchased (liability is limited to the purchase price of the item).
Delays or negligence caused by third-party subcontractors or EPCs (subject to the terms of your Installation Agreement).
10. Indemnification
You agree to indemnify, defend, and hold harmless The Solar Soldier LLC from any claims, liabilities, damages, and expenses (including legal fees) arising from your violation of these Terms or your misuse of our products or services.
11. Dispute Resolution: Arbitration & Class Action Waiver
Please read this carefully. It affects your rights.
11.1. Governing Law: These Terms are governed by the laws of the State of Illinois.
11.2. Arbitration: Any dispute arising out of or relating to these Terms, the purchase of merchandise, or your use of the website shall be resolved through binding arbitration in DuPage County, Illinois, rather than in court.
11.3. Class Action Waiver: You agree to resolve any disputes on an individual basis and waive your right to participate in a class action lawsuit against The Solar Soldier LLC.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to the website. Your continued use of the website or services following the posting of revised Terms means that you accept and agree to the changes.
